Products / Completed Operations — $5M

What this clause says

Products and Completed Operations coverage with a limit of not less than $5,000,000 per occurrence and in the aggregate, which may be satisfied by a combination of primary and excess/umbrella policies.

What this means in plain English

Coverage for bodily injury or property damage caused by your finished product after it leaves your facility. The $5M limit is the most common contract manufacturer requirement.

What it means for a CDMO program

This is your single most important coverage. Most CDMOs satisfy this with $1M primary + $4M umbrella. Verify the umbrella actually drops down for products — some umbrellas exclude products if the underlying CGL has a manufacturing exclusion or restrictive products endorsement. Also verify products/completed ops aggregate is separate from general aggregate.

Carrier notes

The dedicated life-sciences markets are comfortable at $5M. Going to $10M typically requires excess from a second carrier or a London-market layer.

How this evaluates

The Decoder applies these rules in order; the first match wins.

  • products › total limit is at least $5M → Compliant: Total products limit meets $5M.
  • products › total limit is at least $2M → Borderline: Products limit is below $5M but above $2M — likely needs an umbrella increase.
  • products › total limit is not set → Gap: No products liability limit indicated — this is the highest-risk gap.

Questions about limits

Products / Completed Operations — $5M — common questions

Why do sponsors require $5M products specifically?

+

It is the long-standing market default for contract manufacturer MSAs in pharma and medical device. Sponsors have settled on it as a balance between meaningful coverage and what mid-market CDMOs can realistically procure.

Does the $5M need to be primary or can I stack umbrella?

+

Typically $1M primary plus $4M umbrella satisfies the requirement, provided the umbrella drops down for products and the products aggregate is not exhausted by other claims. Read the umbrella form carefully.

How much does $5M products typically cost for a CDMO?

+

For a $20M-revenue oral-solid-dose CDMO, expect $30K-$70K per year. Sterile injectables, biologics, or oncology products start higher and can exceed $200K.
